Terms of Service

1. Acceptance

By accessing or using WI Athlete(the “Service”) operated by [OPERATOR: legal entity name] (“we,” “us”), you agree to these Terms of Service and our Privacy Policy. If you don’t agree, do not use the Service.

If you accept these Terms on behalf of a school, athletic department, or other organization, you represent that you have authority to bind that organization.

2. Account types

WI Athlete offers five account types:

  • Free— athletes, parents, fans. Browse results, follow athletes, receive recap emails. No paid features. Always free, forever.
  • Coach Pro— head coaches managing a team. Roster management, results entry, athlete recaps, parent broadcasts. Paid.
  • Meet Host— schools hosting their own meets. Entry-fee collection via Stripe Connect, real-time entry reports, custom meet pages. Paid (annual or per-meet).
  • Recruiter Free— verified college coaches with .edu email. Search, 25-athlete watchlist, weekly digest. No charge.
  • Recruiter Pro and Recruiter Department— paid recruiter tiers with unlimited watchlists, career-arc graphs, bulk export, and (for Department) up to 10 coach seats on one invoice.

3. Your responsibilities

You agree to:

  • Provide accurate information when creating an account or claiming a team.
  • Keep your password, coach PIN, or magic-link tokens confidential. You are responsible for activity under your account.
  • Use the Service only for lawful purposes consistent with these Terms.
  • Comply with all applicable laws, including NCAA recruiting rules if you’re a college coach, FERPA if you’re a school employee, COPPA if you collect data on under-13 athletes through us, and CAN-SPAM if you send email broadcasts.

4. Acceptable use

You agree NOT to:

  • Create a fake recruiter account, impersonate a coach you are not, or claim a team you don’t coach.
  • Use the Service to harass, threaten, or otherwise harm any athlete, parent, coach, recruiter, or operator.
  • Scrape, mirror, frame, or systematically download our content without our prior written permission. Public meet results are FERPA directory information, but the platform that surfaces them — rankings logic, leaderboards, UI, slugs, audit data — is our copyrighted work.
  • Republish our data as if it were your own data product. You may quote individual results for journalism, advocacy, or fair-use commentary with attribution.
  • Probe, attack, or interfere with the Service or its infrastructure (rate limiting, fuzzing, denial-of-service, vulnerability scanning without coordinated disclosure).
  • Use the Service to circumvent NCAA recruiting calendar rules. Recruiter accounts cannot bypass message classification, the recruiter → HS-coach channel, or the per-recruiter throttle.
  • Reverse-engineer, decompile, or attempt to derive source code from the Service except where allowed by law.

Violations result in account suspension and, where applicable, referral to the user’s school’s athletic compliance officer, the NCAA, or law enforcement.

5. Subscriptions and payments

Paid tiers (Coach Pro, Meet Host, Recruiter Pro, Recruiter Department) are billed annually unless an alternative period is offered. Auto-renewal is on by default. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period.

Refunds.We’ll issue a pro-rated refund within 30 days of purchase if the Service materially fails to deliver promised features, at our discretion. Past 30 days, refunds are at our discretion only.

Payment processing.All payments are processed by Stripe. Stripe’s terms apply in addition to ours. We never see your full card number.

Meet Host entry fees. For schools collecting meet entry fees through Stripe Connect, funds flow from the entering team to your school athletic department, minus the Stripe processing fee. We charge a per-meet platform fee that’s disclosed at the point of payout setup.

Price changes.If we change subscription prices, we’ll notify you by email at least 30 days before your next renewal. You can cancel before renewal if you don’t accept the new price.

6. Intellectual property

Our property. The Service, including its name, logo, code, UI, design, rankings algorithms, audit logic, and the platform-wide corpus of organized results, is the property of [OPERATOR: legal entity name]. You may not copy, modify, or distribute it without our written permission.

Athlete performances. We don’t claim ownership of individual athletic performances. Times, distances, places — those belong to the athletes who produced them and to the host schools. We organize and surface them as a public service.

User-submitted content. By submitting content (roster info, optional profile data, announcements, recruiter messages), you grant us a non-exclusive, worldwide, royalty-free license to host, display, and process that content for the purpose of operating the Service.

Trademarks.“WI Athlete”, the WI Athlete wordmark, and the icon badge are trademarks of [OPERATOR: legal entity name].

7. Third-party content and links

The Service displays results and metadata from third-party timing companies (AccuRace, AthleticLive, MileSplit, PrimeTime, HyTek). We don’t guarantee their accuracy. We don’t endorse the third-party services we link to, and we’re not responsible for their content.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We don’t warrant that the Service will be uninterrupted or error-free, that any specific result will be available, or that any defect will be corrected. Athletic rankings are best-effort and may be revised as data quality improves.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, [OPERATOR: legal entity name] WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions don’t allow these limitations, so they may not apply to you in full.

10. Indemnification

You agree to defend and indemnify [OPERATOR: legal entity name] from any claim arising out of your misuse of the Service, your violation of these Terms, or your violation of any third-party right (including any privacy, intellectual property, or contract right) by your use of the Service.

11. Suspension and termination

We may suspend or terminate your account at any time if we reasonably believe you’ve violated these Terms or if keeping your account active would harm the Service or its users. We’ll give you reasonable notice unless the violation is severe (fraud, harassment, NCAA-rule circumvention, security incident).

You may terminate at any time by canceling your subscription and deleting your account via [OPERATOR: privacy@wiathlete.com]. Public results tied to your athletic performance remain visible after termination (FERPA directory information; see Privacy Policy section 6).

12. Governing law and disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in [OPERATOR: Wisconsin county for venue, e.g. “Dane County”]. You consent to the personal jurisdiction of those courts.

Either party may seek injunctive relief in any court for infringement of intellectual property or violation of confidentiality.

13. Changes to these Terms

We may update these Terms. When we do, we bump the version number and effective date at the top, and notify users by email for material changes. Continued use after the effective date constitutes acceptance.

14. Miscellaneous

  • Entire agreement. These Terms plus the Privacy Policy are the entire agreement between you and us. They supersede any earlier communication.
  • Severability. If a provision is unenforceable, the remaining provisions stay in effect.
  • No waiver. Failure to enforce a provision is not a waiver of that provision.
  • Assignment. You may not assign these Terms without our written consent. We may assign without notice in connection with a merger, acquisition, or sale of assets.
